Recently, bioethicists and the UNCRPD have advocated for supported medical decision-making on behalf of patients with intellectual disabilities. But what does supported decision-making really entail? One compelling framework is Anita Silvers and Leslie Francis’ mental prosthesis account, which envisions supported decision-making as a process in which trustees act as mere appendages for the patient’s will; the trustee provides the cognitive tools the patient requires to realize her conception of her own good. We argue that supported decision-making would be better (...) understood as a collaborative process, giving patients with intellectual disabilities the opportunity to make decisions in a respectful relationship with trusted others. We offer an alternative account of supported decision-making where the primary constraint is to protect the patient from domination by the trustee. This is advantageous in its preservation of the prospects for genuine collaboration, for the mental prosthesis approach ultimately reinforces a problematic ideal of isolated patient self-determination. The celu of the philosophical literature on the hole argument is the 1987 paper by Earman \& Norton ["What Price Space-time Substantivalism? The Hole Story" Br. J. Phil. Sci.]. This paper has a well-known back-story, concerning work by Stachel and Norton on Einstein's thinking in the years 1913-15. Less well-known is a connection between the hole argument and Earman's work on Leibniz in the 1970s and 1980s, which in turn can be traced to an argument first presented in 1975 by (...) Howard Stein. Remarkably, this thread originates with a misattribution: the argument Earman attributes to Stein, which ultimately morphs into the hole argument, was not the argument Stein gave. The publication of John Knox's First Blast of the Trumpet in 1558 had engendered a radical debate about the public role of women and the nature of female authority and obedience. Howard was not the only author who attempted to refute Knox's tract. The Marian exile and future Bishop of London, John Aylmer, the Catholic Bishop of Ross, John Leslie, and the Catholic, Scottish lawyer, David Chambers, all published books disproving Knox's allegations about women's unfitness for rule. Richard (...) Bertie, husband of Catherine, Duchess of Suffolk, also prepared a manuscript refutation which was never published. The published works are moderately well known, and have been discussed elsewhere. This article concentrates on Howard's unpublished contribution to the Knox debate. The tract is important because of its length and detail, its conclusions regarding the potential role of aristocratic women, and because of Howard's personal reputation and aristocratic connections. The �Defense� was both eloquent and persuasive, analysing women's legal, historical and theological status within early modern society. Howard presented alternative interpretations of female stereotypes found in sermons and polemical writings. His commentaries on Genesis, Athalia, Jezebel and Deborah show how traditional biblical stories could be interpreted in radically differing ways, with profound implications for contemporary women. Because of the length of Howard's tract, this article can present only a summary of his main conclusions. His interpretation of the first three chapters of Genesis will be presented in rather more detail as an indication of the complexity of the early modern debate about women, and the dangers of trying to attach simplistic labels to individual attitudes. The focus of this article is J. Leslie Mitchell’s Spartacus (1933), his fictional representation of the slave rebellion in ancient Rome led by the eponymous gladiator. The article begins by examining Mitchell’s contribution to debates over the role of the revolutionary writer in Left Review in the mid-1930s and his place in the British Left in this era, before going on to survey the ways in which the figure of Spartacus and the German Spartacists are represented across Mitchell’s oeuvre. It then explores key source material utilized in the writing of the novel, as well as outlining comparisons between Mitchell’s representation of Spartacus and those of his fellow novelists Howard Fast and Arthur Koestler. Including close readings of Spartacus and informed by archival research and previously unpublished manuscript items, the article argues that at the same time as denouncing the cruelties of Roman rule, Spartacus also signals Mitchell’s passionate opposition to what he considered the violent histories of oppression suffered by the commons of the earth of all times, culminating in the capitalist crisis of Mitchell’s own period in the 1930s. Mitchell creates this effect of historical simultaneity by writing a work of myth-history – as opposed to historical realism or political propaganda – that employs the utopian legend of the Golden Age to inspire radical dissent against modern deprivation. Shaping the Normative Landscape is an investigation of the value of obligations and of rights, of forgiveness, of consent and refusal, of promise and request. David Owens shows that these are all instruments by which we exercise control over our normative environment.

In an important departure from theories of causation, David Owens proposes that coincidences have no causes, and that a cause is something which ensures that its effects are no coincidence. In Causes and Coincidences, he elucidates the idea of a coincidence as an event which can be analysed into constituent events, the nomological antecedents of which are independent of each other. He also suggests that causal facts can be analysed in terms of non-causal facts, including relations of necessity. Thus, (...) causation is defined in terms of coincidence, and coincidence without reference to causation. David Owens challenges the ideas associated with Hume, Davidson and Lewis, constructing a theory which distinguishes nomological necessity and sufficiency from their logical counterparts. He is able to offer novel solutions to the major problems of causation, including the direction of causation, the logical form of causal statements, the distinction betwen causal connections and logical connections, and the relationship between psychological and physical causation. There have undoubtedly been ample reasons to discourage a translator from approaching this commentary on the Metaphysics. The reasons stem mainly from the lack of a critical text. As is well enough known, such a text is at present in preparation by the Dominicans. Until it appears, attempts even at discussing the many disconcerting problems about the commentary run the risk of proving futile. In consequence, discussions have fallen off in recent years. As Rowan is careful to point out in (...) his introduction, there is sufficient evidence not only that errors have been made through simple negligence in the editions of the commentary, but also that "all sorts of liberties" may have been taken with the text. What we have at present, moreover, might possibly be a running text based on redactions dating from different years in St. Thomas' teaching career. If one may judge from the way Rowan presents the different views, he personally prefers hypotheses that simplify the situation and allow the text now available to be considered as a single continuous writing left in its present form by Aquinas himself. This dissertation seeks to explicate the fundamental contributions of phenomenology to the philosophy of language as it is presently conceived in the Anglo-American tradition for which John Searle serves as the representative. They are the essence of language in the later essays of Martin Heidegger and the perspicacious description of the experience of speaking in Maurice Merleau-Ponty. ;After roughly describing the subjectivistic assumptions, the questions, and the goals of the philosophy of language in the works of Searle, the study proceeds (...) to explore how phenomenology's characteristic search for essences and concern for lived-experience can set it on a more circumspect path. ;The study elicits the following conclusions. Despite significant contrasts, there is a solid complementarity between Heidegger and Merleau-Ponty as phenomenologists concerned with the language phenomenon. Heidegger and Merleau-Ponty make substantial contributions to the philosophy of language. Specifically, its traditional subjectivistic assumptions are phenomenologically re-thought; answers to its customary questions are formulated from a pre-subjective and pre-objective perspective; and the traditional problem of how language and speaking can be creative is resolved. Finally, some of the concerns of a complete philosophy of language left unaddressed by Heidegger and Merleau-Ponty are itemized. (shrink)

Joseph Owens presents an introduction to metaphysics designed to develop in the reader a habitus of thinking. Using original Thomistic texts and Etienne Gilson's interpretation of St. Thomas Aquinas, Owens examines the application of metaphysical principles to the issues that arise in a specifically Christian environment. An Elementary Christian Metaphysics focuses on questions of existence and the nature of revealed truths. Following his historical introduction to metaphysics, Owens provides a general investigation of the first principles and causes (...) of being and also a study of knowledge and of the divine nature and attributes in light of natural reason. Kripke's Pierre puzzle undermines some of the central epistemic intuitions that underlie traditional defences of the Fregean assumption that sentences'S believes that Fa ‘and'S believes that Fb’ can differ in truth value, even though a = b. Millian theorists have seized on this and employed the puzzle to reject the Fregean assumption itself. I argue that Millians are correct in rejecting traditional defences of the Fregean assumption, but they are wrong in rejecting the Fregean assumption itself. The contributors set out to demonstrate the influence of the computer - not just in the philosophy of mind, but also in epistemology, metaphysics, logic and the philosophy of mathematics. Even ethics and ethical reasoning have been explored through the use of the computer.

There is no right to blackmail. So says the law and so say most moral observers. A few libertarian voices have been raised in defence of blackmail but such a defence is liable to be treated as a reductio of the defender's own free market philosophy. However, it is surprisingly difficult to say just what is wrong with blackmail.

At a conference on ‘Leisure in Canada,’ held more than a decade ago at Montmorency in Quebec, a participant observed that ‘practically all writers on the subject take Aristotle as the point of departure in discussing leisure but seldom seem to move from that point.’ At first sight this statement may seem surprising. How is it to be understood? Certainly recent writers on leisure do in fact list Aristotle's conception as one of the significant positions on it.

In our thinking about what to do, we consider reasons which count for or against various courses of action. That having a glass of wine with dinner would be pleasant and make me sociable recommends the wine. That it will disturb my sleep and inhibit this evening’s work counts against it. I determine what I ought to do by weighing these considerations and deciding what would be best all things considered. A practical reason makes sense of a course of action (...) by recommending it, by highlighting some good or desirable feature of it which could move a reasonable agent to perform it. When thinking about what to do, we also attend to our obligations. Perhaps I have promised to remain clearheaded this evening. Given this I am obliged not to drink. How should this consideration affect my deliberations? According to Davidson, the fact that an action would be a breach of a promise ‘is a count against the action, to be weighed along with other reasons for the action’ (Davidson 2004: 177). This suggests that obligations are a sub-set of our reasons, they are one input into the process of determining what action would be reasonable or justified all things considered. One can see why Davidson might say this. After all, having carefully considered the matter, I may decide not to keep my promise. Furthermore this may be the right thing to do, the most reasonable course of action available to me in the light of all the relevant factors. Nevertheless this description seems to miss something important about a promise. The fact that I promised not to drink does not merely recommend not drinking as does the prospect of a restless night; it places a demand on me. Drinking would not be just inadvisable; it would now be a wrong. And even if such a wrong might on the whole be justified, even if committing this wrong is the right thing to do, in drinking I refuse a demand, I don’t just reject a recommendation. It is widely held that a promise provides you with a moral reason to fulfill it, whereas the fact that drinking would make you lose sleep does not, typically, constitute such a reason.. (shrink)

Virtue ethics has been criticized for having little or nothing to say about contemporary moral issues. However, virtue ethics can address contemporary moral issues by evaluating social practices and institutions. Nor is virtue ethics limited to the politically conservative uses to which some theorists have put it. Indeed, virtue ethics can be a powerful engine for social progress. To illustrate, this paper will develop an Aristotelian critique of the white, middle-class, heterosexual American traditional family.
